To use the PinPet website or mobile application, you must read and fully agree to the Terms and Conditions of Use outlined below. Every visit to our website and mobile application (hereinafter referred to as the “Application”) signifies that you have read the Terms and Conditions of Use and agree to them in full, and that you will use all content at your own responsibility. If these terms are not acceptable to you, please refrain from using our services or the Application.

Terms and Conditions of Use for the PinPet Website and Mobile Application

These Terms and Conditions constitute a contract between:

PinPet Novi Sad, the founder and owner of the PinPet website and mobile application, headquartered in Novi Sad, Đorđa Nikšića Johana 3, registered with the Serbian Business Registers Agency under registration number 68068096 and tax identification number 115067040 (hereinafter referred to as “PinPet Novi Sad”)

Each individual user of the PinPet website and mobile application (hereinafter referred to as the “Service User”)
(jointly referred to as the “Contracting Parties”).

1. Obligations of the Contracting Parties

PinPet Novi Sad agrees to provide services defined by this Agreement in accordance with the applicable laws of the Republic of Serbia. The Service User agrees to comply with all contractual provisions when using the PinPet website and Application. The Contracting Parties agree that, in order to fulfill these obligations, PinPet Novi Sad must collect, process, and store personal data of Service Users in accordance with Serbian law and the Privacy Policy, which is available for review by all Service Users. By accepting this Agreement, each Service User confirms that they are familiar with and agree to the Privacy Policy.

2. Legal status

According to Article 3. of the Law on Classification of Activities of the Republic of Serbia, PinPet Novi Sad is registered as an advertising agency providing free and paid services for posting and promoting ads on the website and Application.

3. Free and Paid services

Free and Paid Services
PinPet Novi Sad provides Service Users with free access to the website and Application, including free ad posting, in accordance with Article 2 of the Law on Advertising and Article 3, Paragraph 6 of the Law on Electronic Commerce of the Republic of Serbia.
Additionally, PinPet Novi Sad offers paid services for:
• Access to “Premium” content within the Application
• Promotion of free ads to increase visibility and reach
• Banner advertising on the website and Application
By purchasing a subscription, the User gains access to Premium content in accordance with the selected subscription terms. The User explicitly agrees to automatic renewal of the subscription unless canceled before the renewal date. Upon renewal, the User waives the right to a refund unless otherwise stated in the service terms. Renewal will be charged according to the selected payment method and current terms. PinPet Novi Sad reserves the right to change the prices of paid services without prior notice.

4. Registration, Use of Services, and Advertising by Users

To use services and post ads on PinPet, users must create an account (free registration). Registration is completed by logging into the Application using an email address and password, or via Google or Apple accounts. Registered users can post ads and are subject to all rights and obligations under the Law on Advertising. Each user may have only one registered account. By registering, the user agrees to be contacted via email or phone for ad-related purposes or support from the PinPet Novi Sad team. The user agrees that the content of their ad—including text, photos, and contact number—may be published in the Application and on PinPet Novi Sad’s social media pages, making it publicly accessible. All ads, including those with paid promotions, must comply with the Law on Advertising and the Law on Copyright and Related Rights. Non-compliant ads will be removed, and the user will be notified.

5. Usage restrictions

Users agree to the following restrictions when using the website and Application:
• Ads must comply with the Law on Advertising
• Ads must respect animal welfare laws and not violate animal rights
• Ads must not promote stolen, sick, or non-owned pets
• Ads must not contain falsehoods, offensive content, or misleading information
• Ads must not contain political content or public declarations
• Individuals may not advertise new goods unless registered as a business
• Ads may not include personal names without explicit consent
• PinPet Novi Sad reserves the right to remove any ad that threatens its operations or the safety and rights of others

6. Prohibited Actions

Users agree not to:
• Post identical ads from multiple accounts
• Repeatedly post similar ads (“spamming”)
• Include URLs to businesses or other websites in ad descriptions
• Use edited images or logos in ad photos
• Use special graphic characters to highlight ads
• Frequently post and delete ads to manipulate visibility (more than once every two days).

7. Commenting Rules

Registered users may post and delete comments, but must not:
• Send offensive or spam messages
• Use URLs to ads in spam emails
• Promote other websites or portals through messages

8. Transactions between users

PinPet Novi Sad does not mediate transactions between users. It serves as a platform for pet owners, product manufacturers, and service providers to connect with potential buyers. All transactions are at the users’ own risk. PinPet Novi Sad is not liable for any damages resulting from user-to-user transactions. Users are advised to exercise caution.

9. Copyright and Prohibition of Unauthorized Copying and Use of Content Published on the Website and Application

In accordance with the fundamental provisions of the Law on Copyright and Related Rights of the Republic of Serbia, any unauthorized copying or scraping of content or parts of content published on the website or Application—whether manual or software-based—is strictly prohibited. Content includes page text, advertisements, user data, photographs, logos, graphic designs, and all other materials considered copyrighted works under the law. PinPet Novi Sad reserves the right to pursue legal action against violators. Service Users retain copyright over the individual text and photographs included in their advertisements.

10. Data Collection and Processing, Including Personal Data

PinPet Novi Sad collects, processes, and stores data in accordance with the applicable laws of the Republic of Serbia and the Privacy Policy, which is available for review by all Service Users. By accepting the provisions of this Agreement, each Service User confirms that they are familiar with and agree to the Privacy Policy.
PinPet Novi Sad collects personal data from registered Service Users, or company data in the case of legal entities. The collection of IP address data for user identification is a legal obligation under Article 16 of the Law on Electronic Commerce. All other purposes for data collection are explained in the Privacy Policy.
Service Users agree that certain personal data—specifically, data that is an integral part of the advertisement posted in the Application—will be accessible to other Service Users and publicly available online. Registered Service Users accept the possibility of being contacted via email or SMS by other Service Users or by the administrative team of PinPet Novi Sad, for the purpose of further development and improvement of the Application, as well as for certain marketing activities.
Service Users have the right to withdraw their consent given by accepting this Agreement for the collection and processing of personal data, and they also have the right to request modification or deletion of their personal data.
More information about these rights can be found in the Privacy Policy. PinPet Novi Sad is not responsible for the accuracy of data entered into the Application by third parties, nor for the accuracy of results derived from processing such data.

11. Breach of Contractual Provisions

Any breach of the provisions of this Agreement, disregard for the restrictions outlined herein, or violation of the law by a Service User may result in a warning, or temporary or permanent suspension of the user account. The administrator will first issue a warning, followed by a decision on temporary or permanent account suspension.
Service Users whose accounts are suspended—either temporarily or permanently—are not entitled to any compensation for damages resulting from their inability to use PinPet Novi Sad services during the suspension period. These measures may also be applied in cases where no contractual breach has occurred, but where certain actions or omissions by the Service User hinder the business operations of PinPet Novi Sad.

12. Disclaimer of Liability

In accordance with the following articles of the Law on Electronic Commerce of the Republic of Serbia, PinPet Novi Sad disclaims liability:
• Under Article 16, PinPet Novi Sad is not responsible for the content of electronic messages and comments exchanged by users through the Application.
• Under Articles 17 and 18, PinPet Novi Sad is not responsible for the content of data stored in the database and/or published in the Application.
• Under Article 19, PinPet Novi Sad is not responsible for content on other websites when Service Users include links to those sites in their ads or messages.
• Under Article 20, PinPet Novi Sad is not obligated to review data stored, transmitted, or made available by Service Users, nor to investigate circumstances that may indicate unlawful behavior.

13. Liability in Case of Unavailability or Suspension of Ads in the Application

Due to force majeure or technical issues, the Application may be unavailable to all or some users for a certain period. In such cases, PinPet Novi Sad is not liable for any damages resulting from the suspension of ad broadcasting.

14. Contacting the Administrator

To contact the PinPet administrative team, users are directed to the contact form available on the website or within the Application. Responses from the administrative team do not necessarily reflect the views of the founders, and therefore Service Users cannot claim any rights based on such written correspondence. Publishing any written correspondence between the PinPet Novi Sad support team and a Service User is strictly prohibited.

15. Privacy Policy

The collection, processing, and storage of personal data by PinPet Novi Sad is carried out in accordance with the applicable regulations of the Republic of Serbia and the Privacy Policy, which is available for review by all Service Users. By accepting the provisions of this Agreement, each Service User confirms that they are familiar with and agree to the Privacy Policy.

16. Amendments to Contractual Provisions

These Terms and Conditions are subject to change. In the event of significant modifications, PinPet Novi Sad reserves the right to require users to re-accept the Terms and Conditions for using the website and Application, and to deny access to users who do not accept the revised Terms and Conditions.
